The Energy Policy Act of 2002 is currently in the final stages of negotiation with the final conference discussions occuring this week. A controversial section on regulation of hydropower dams remains to be resolved. The Senate version of the bill favors the hydropower industry by sidestepping environmental protections and saddling natural resource agencies with redundant procedural hurdles, while the House version is a compromise hammered out by conservation organizations and representatives of the hydropower industry. More: American Whitewater o On the weekend of September 21, 2002, adult chinook and coho salmon began dying by the thousands as they returned to the Klamath River and encountered dramatically low river flows and poor water quality, including high water temperatures well above the tolerance levels of these cold-water fish. Threatened adult coho salmon migrate up the Klamath River from mid-September through early November to spawn, with peak migration coming in early October.. The bill will significantly expand the National Wild & Scenic Rivers System and the National Wilderness Preservation System on federally managed public lands in California. As Congress considers reforms to address the scandal-plagued planning process at the U.S. Army Corps of Engineers, American Rivers hailed a National Academy of Sciences finding today that the agency's studies of costly and controversial projects "should be subjected to independent review by objective, expert panels." An important meeting concerning the relicensing of SCE's Borel powerplant, and flows required for whitewater recreation on the Dam Run, is scheduled for Wednesday, October 2, at 1:00 PM at the Forest Service offices in Kernville. John Gangemi, Conservation Director for American Whitewater will be attending, and all Kern paddlers are encouraged to participate. Your support can make a difference! That evening there will be a Boater's Meeting at 6:00 at the Pizza Barn where John will discuss the language in the KR3 relicensing settlement agreement regarding flows on the Upper Kern below Fairview Dam.

Speaking of El Nino... According to the El Niño/Southern Oscillation (ENSO) Diagnostic Advisory issued September 12, 2002, El Niño conditions continued during August, with SST anomalies greater than +1°C in the central equatorial Pacific. A summary of eight ENSO forecasts suggests that warm episode conditions are likely to continue through January 2003. The Precipitation Outlook for January to March, 2003, issued by the Climate Prediction Center September 18, shows an increased probability of above average precipitation in Southern California. During the month of September the equatorial Pacific has continued to warm. TAO/TRITON graphics of depth averaged temperature show the warming that has occurred from August 26 to September 25.

An aerial survey of the Forks was done by the Forest Service in a low-flying helicopter. Brian Cosgrove, river ranger, was optimistic.The river corridor is still green. Assuming you have some time to look around when you run the Forks, you should be fairly pleased that the McNally Fire didn't turn the run into a lunar experience.

A big THANK YOU! to all of our wonderful customers that came to the store or bought boats and used gear on-line. Even if you couldn't make the sale, we greatly appreciate all the business throughout this year from everyone. Without you, we wouldn't be here!
Everything leftover from the sale can be see on-line in our Used Boat Barn and New Boat Barn. There are over 60 used boats going up! There are some fantastic deals still to be had on new boats as well, as we make room for next season's inventory. The site is not completely updated; we are adding boats daily. Meanwhile, if you want something you don't see, give us a call, 800-376-7303. We will be happy to verbally tell you what we have. The boat update should be completed by Friday, Sept 13th.

Brian hopes to put a lot of effort into Brush Creek this winter in anticipation of trees falling into the run. We may need to get a volunteer group together multiple times to help do some clean- up.
Please remember to keep especially vigilant this coming year for logjams and other obstacles when you are river running. Remember... when in doubt, get out and scout!

This concern is a distraction from the real issue, and is generally considered a red herring or non-issue by FERC and other groups that are intimately familiar with the licensing process. Hostile Waters concludes that PWC use, which is allowed on over 98 percent of the nation’s surface waters, not only poses a serious and disproportionate safety threat, but significantly diminishes the ability of the public to enjoy other water-related activities, degrades the quality of recreational waters and adversely impacts a wide variety of wildlife. According to McNally Fire Incident Information site the McNally Fire is now 100% contained and has burned 150,696 acres. A total of 820 personnel including 11 helicopters, 3 dozers, 27 water tenders, 23 fire engines, 12 handcrews, and numerous support personnel are continuing to work the fire. Estimated cost to date is $49.7 million.
